Inspired by the Pakistan Lawyer Protest against President Pervez Musharraf’s attempt to hold onto power after the 2007 Pakistani election, over 1300 American lawyers and law students signed this request to Rep. Conyers and Sen. Leahy urging them to defend the rule of law and uphold the US Constitution against the egregious abuses of the Bush Administration. The group is known as The American Freedom Campaign.
Abuses include but are not limited to: torture, extraordinary renditions, warrantless wiretapping, jailing without habeas corpus, and the destruction of evidence such as the CIA interrogation videotapes and five million White House e-mails.
Bruce Fein, Mario Cuomo, Jesselyn Radack, a former Justice Department ethics lawyer, Michael Ratner, president of the Center for Constitutional Rights, Marjorie Cohn, president of the National Lawyers Guild, and AFC’s Steven Fox are among the participating lawyers.
Message to House Judiciary Committee Chairman John Conyers and Senate Judiciary Committee Chairman Patrick Leahy from American Lawyers Defending the Constitution
We are lawyers and law students in the United States of America. As such, we have all taken (or will be taking) an oath obligating us to defend the Constitution and the rule of law from those who would violate and subvert them, and to hold wrongdoers accountable.
We believe the Bush administration has committed numerous offenses against the Constitution and may have violated federal laws. Evidence exists that it has illegally spied on Americans, tortured and abused men and women in its direct custody, sent others to be tortured by countries like Syria and Egypt, and kept people in prison indefinitely with no chance to challenge the bases of their detention. Moreover, the administration has blatantly defied congressional subpoenas, obstructing constitutional oversight of the executive branch.
Thus, we call on House Judiciary Chairman John Conyers and Senate Judiciary Chairman Patrick Leahy to launch hearings into the possibility that crimes have been committed by this administration in violation of the Constitution, federal statutes, and international treaties. We call for the investigations to go where they must, including into the offices of the President and the Vice President. Should these hearings demonstrate that laws have in fact been broken by this administration, we support all such legal and congressional actions necessary to ensure the survival of our Constitution and the nation we love.

The American Lawyers Defending the Constitution campaign is being coordinated by the American Freedom Campaign (AFC), a grassroots and grasstops movement to defend the Constitution, and is a joint project of AFC, the Center for Constitutional Rights, National Lawyers Guild, Alliance for Justice, Equal Justice Society, and the American Freedom Agenda.
UPDATE:
Sorry that I did not see this post/thread earlier. I just wanted to let everyone know that this campaign was actually launched on December 20, 2007, after about six weeks of organizing following the events in Pakistan. (It is certainly our bad for not have the year on this release online, but you can see as proof of the 2007 launch that it says “Thursday, December 10.”) Obviously, we wish it had more of an impact when it was launched, but, for what it is worth, it helped AFC develop more of a reputation on the Hill which has led to productive work on issues ranging from congressional subpoenas to the unconstitutional nature of the U.S.-Iraq agreement.
Thank you all for your interest.

What’s taken them so long? It’s not like we haven’t been screaming about it for years.
Ellie, congrats! ;-)
This is very exciting news, and also about damn time!
I’m surprised Romero and the ACLU didn’t clambor aboard…?
Dugg right here.
Won’t you please join me?
Bravo Ellie, and bravo lawyers!
We Digg Elliot — We Digg Elliot
Do I have to…? ;-)
Please forgive an OT: OUr local paper, Austin, has a collection of political cartoons about the shoe story; I do not know if that has been the case in other papers. Point is our Pres. is being surrounded by shoes, in the alternative, lots of boots, etc. The story keeps right on. Thanks
I apologize for being so cynical about the timing but the Pakistani lawyers took to the streets in October 2007. While the netroots were forming up to begin the struggle with the reichwing our Constitution was already being shredded. That has been one of the core issues of the left blogosphere since day one.
Kudos to these guys for doing this, however. Better late than never. Now if we can only get the spineless Congressional Dems to do something about it instead of pissing their pants every time a Rethug walks by.
Indeed. Fuck ‘em. This bullshit show of “concern” after almost a decade of silence just serves to underscore the illusion of a remedy and the breach of faith by the lawyers. Fuck ‘em, the fucking fucks. Let ‘em give some fucking money to the ACLU or the Center for Constitutional Rights. Or to Valerie Plame and Joe Wilson. Gutless fucking fucks.
OH!
EXACTAMENTO!!!!!!!!!!!
maybe late, but
WELCOME TO THE PARYAY!!!!!!!!!!!!!!!
Did somebody yell “Par-tay”…? ;-)
Placed into the appropriate slot in our Better Late Than Never file. Actually, I am
very gladecstatic that someone is going to help us out on this, I know GG is getting tired. It seems like there are so many Strict Constructionists from the Federalist Society who apparently cannot decipher plain English, except in the case of the Second Amendment.Thank you Teddy, and I agree with you all,
It’s about time!
yes, you mangy ’stronomer
RevBev – in the parlance, I think they would say, “That story has legs” :)
Don’t restrain yourself, tell us what you really think…
Aren’t we glad? I hope we get some good news about the journalist…soon.
Hi Ellie, thanks for the post.
“Let’s not turn policy differences into crimes.” Cass Sunstein, July 2008.
ANOTHER thought here…………
WHERE’S THE REST OF EM’!!!!!!??????????
there should be thousands of good Americans up in arms about this.
WEHRE ARE THEY????
YEARS ago would be perfect.
NOW would work!!!!!!!!!!!!
hello???????????????????????????????
Nice job, btw…! ;-)
Elliott, thanks very much for the post. Last I checked, it had nine diggs.
Yeah, what is it with these nutjobs and the Second Amendment? The citizens outgun every police department in the country. What the hell are they worried about?
i propose sending this off snail mail and email and fax and drop off to every single lawyer we know, all of us!
i have a few in my life, one prof and several socially. pass it along.
WE THE PEOPLE, after all………
i’ll do it.
will YOU?
Oh no.
Yes, let’s please do.
Just a reminder of the huge mountain that must be climbed before anyone is held accountable.
right ON target!
How about when it’s illegal? Is that a crime?
Mtn’s with mighty steep slopes…! A truth commission is all that’s proposed so far…! 8-(
thanks CT, and you too Boo
I don’t know, but if they cared half as much about any of the other freedoms, we should be a lot better off, wouldn’t we?
i call bullshit…
the center for constitutional rights has been defending habeas for terror suspects since early 2002. from wikipedia:
and it’s the national lawyers guild that defends street activists – remember this year’s RNC and all the bogus police actions and arrests? who was organizing to defend the activists? the nlg, just like they always do.
don’t know if this qualifies as a disclaimer or as evidence, but i volunteered for the nlg as a legal observer during rnc week 2004 and for a week in miami during the ftaa protests in 2003. i’ve had nothing but good experiences with them.
This keeps reminding me of Dean’s biggest gripe about Nixon, we never closed the circle and allowed them to continue in their illicit activities…!
I’m looking, but not finding, another source that argues that the congress has basically voluntarily eviscerated itself. Gave up the war powers decades ago. Oversight has become a joke, at least under R prez (whether congress is R or D). Gave up tax policy to exec too. So now all congress can do is spend. Wonder why? /s
I can’t remember where I heard a good explication of this, but will search a little longer & if I find it, I’ll link.
pretty sure i’m not the first to say this, but i don’t remember who was…
CCR is only org between us and dictatorship, as near as I can figure. This post is about The American Freedom Campaign, which I never heard of before. I think the Qs involve where has the AFC been all our lives?
Accountability for war crimes! Violations of the Geneva and the Constitution. Challenge FISA and Patriot Act and MCA. Take personhood away from corporations. Reforn NAFTA. No more tax shelters. No offshoring of pollution. For openers. Regulate the market place and make them return our assests. This last year was straight out of Shock Doctrine giving public assests to corporation in a giant transfer payment.
Anything yet on this from Glenn Greenwald?
I think that is part of GG’s case….that Congress has flunked out on accountability.
And can SCOTUS be far behind? 5-4 on the most important constitutional decisions in our lifetime? Disgusting.
Yes let’s kick start this ball rolling
(if that even makes sense)
I just wish they had done this eight years ago! Maybe ity is time this country has a permanent Association of Constitutional Lawyers who charter is to look at every peice of legislation and Regulation passed by both Congress and by Presidential Signing statement!!
I Took the Time to Digg this Great and Important Diary, Did you?
ELLIOT!! Excellent work on some very good news. I was looking for the petition to sign, but it’s just for lawyers. Good lawyers, late, but good.
PARTTAY! (My daughter is having an obnoxious Christmas Wear party, and asked to borrow my sweaters and tacky jewelry.) I’ll have her keep them this year, seeings how I won’t be needing them anymore!!
You guys. CheneyCo will be held accountable, it’s just that people are slow. I’m just hoping it happens in their lifetimes.
Does the timing indicate that there is the political will to move legally now?
Thank you Elliot it is a pleasure to read this. Can you ask Glenn Greenwald to do a follow up explanining the timing and the route to accountability…or a link to the explanation. Liebeman comes out against Bush now. Will Bushco’s base throw him to the wolves?
The ACLU has been filing lawsuit after lawsuit and sucessfully getting courts including Bush’s packed SCOTUS to overturn various parts of the Patriot Act, The Military Commissions Act, and fighting for the rights of all the detainees – including people who have been rendered, and is paying for civilian counsel for a lot of the people in Gitmo as well.
I have no answer as to why they haven’t signed this – but they have NOT been silent. In any way.
i have no idea, other than what’s in elliot’s post – that it’s a joint project that includes the ccr and the nlg (which is why i wanted to defend those two)
aHAHAHA
Elliot this post is very informative for me, Thank you well put together. Where is the EFF in this they have been dilligent in the courts on telecom immunity which is a big part of the cover up.
Obama Serves Up Five-Star Science And Rancid Food Choices
Kirk’s up!
Sorry, missed the part at the end where CCR is part of the consortium. Rereading that, I gather that some lawyers groups who have been involved all along, like CCR, are apparently trying to build a broader coalition.
Which still begs the issue about where have ALL the lawyers been all along, and why certain items of the species like Yoo still retain their law licenses.
I’m not implying they’ve been silent, it’s just surprising they’re not on board already…!
law license? i want to see yoo on trial for war crimes.
fair trial, of course. *g*
my guess is it’s a lawyer thing; but you’re right, they have been right up there — and thank goodness!
thank you for the reminder.
it totally makes sense. i guess at the least we’ll find out who our lawyers are.
and “shop” accordingly!
if mine and those i know won’t support this, then out them with the garbage!
could be a twofold cleansing moment, i’m thinkin!
dugg,
please do the same?
See here, the AFC has some stuff on Yoo, too.
OT Everyone must see the YouTube at twolf’s diary – “Robin Williams on the Election” – it’s wonderful.
thanks!
also i see from your link that AFC was launched a year and a half ago to pressure the presidential candidates to pledge to support the constitution. now i think i remember that naomi wolf told us about this when she was here? if so, my bad for not remembering.
The first Obama test.

Back in April, Mark Ambinder did a blog entitled War Crimes.

To which Mia Kulper responded:
Superb! You can be sure that they’re up to no good when they pull that old chestnut out. Any inquiry into poor behavior by elected officials is claimed to be “criminalizing” plain old politics. It tells a person a lot about some folks philosophy on governance…
DUGG and commented there and clicked the thumbs up on each comment.
Total DIGGs now 28.
Glenzilla has been all over it, e.g., this today, which I strongly recommend.

Enjoy.
Another request for congress to do its job, from lawyers. Yeah, that’ll do it.
“We call for the investigations to go where they must,” It’s called impeachment. I didn’t read the whole thing so maybe it’s mentioned. I’m sure Bruce Fein mentioned it. He’s quite inspiring on the subject.
So John Conyers gets another request to please, please! defend our Constitution. Oh please, sir, please use the people’s s recourse to a corrupt government. A solution! one might say. Right there in the Constitution, thought up, written down by those fab founding fathers. Was used rather recently, for something trivial. It’s a pity those dads couldn’t envision a time when the people’s representatives would be so unbelievably deaf to the voice and will of the people. Reams of paper wasted sent to the useless judiciary comm. pleading, arguing, demanding….
Oh wait, we had a hearing. I believe it was called a not impeachment hearing hearing. And John Conyers said, my work is done.

PS Sorry for the rant, thanks for the space, hi all:)
Hi back, rant away!
