Just because the homeowners are not current in their mortgages does not automatically mean that the house is forfeit, even though the debt may still exist.

Phony litigation documents were created to cover up the fact that the banks don’t really know what they own and the failure to properly transfer the documents into the trusts that backed Mortgage Backed Securities (RMBS). That’s not a problem one can “fix.”
So why go through the sham of a review that will only tell them what they already know?

The U.S. needs to take over the process and appoint a receiver to figure out who are the equitable owners of these mortgages, since they don’t seem to have legal owners, and restructure/writedown the mortgages to some sane level reflecting current market values and to create a de facto quit claim on the property in favor of the newly created modified mortgages to quiet title. Then the mortgages can be held by the party whom equity favors.
Then the Government needs to outlaw this type of practice. No more RMBS of this kind, ever again.

There has been fraud in the creation of RMBS, fraud in the collection of mortgage payments, and fraud in foreclosure to cover up the first two frauds. This is not “sloppiness” and it can’t be fixed with contract law.

A paralegal at the foreclosure mill of David Stern has given a deposition to the Florida Attorney General indicating that virtually every affidavit, assignment or other sworn document coming out of that firm is faked.
